    Default When Does Property Left in My Control Legally Become Mine

    My question involves a consumer law issue in the State of: Kansas

    It has been one year since an individual has left property at my residence. When does that property, in the state of Kansas, become mine to do what I wish? I plan on selling it if it is, in fact, legally mine. It has been seven months since I tried to contact them about retrieving their property.

    what form of contact and when have you made contact with the owner and what did you say to them in that contact? How did the property end up at your residence?

    I'm in a band and I was auditioning bass players. He brought his gear to my house (3 bass guitars, and an amp rig) and then left it at my residence. I tried to contact him last July. I called him. The conversation was as follows... " Hey, I need to talk to you about your gear" He replied, " I'm at work let me call you back" and he never did. His property has now been at my residence for approximately one year today.

    and you have made no effort to contact him telephonically or in a written notice since then?


    since you have no right to charge the guy for storage, you have no right to sell the property to attempt to recover your losses. I am having difficulty finding an applicable statute but even without a statute, I would suggest you have no right to sell the property without first notifying the owner of your intent. That means sending him a registered letter giving him some reasonable time to pick up his property or it will be forfeit and disposed of.
