My question involves insurance law for the state of: North Carolina

I was in a domestic partnership and covered as a dependent on his insurance. I am no longer living with this individual. Can he still carry me as a dependent on his insurance even though we are no longer in same household? Should I be offered COBRA?

My natural instinct is to say that it depends on the definition of an eligible employee in the employer's plan document, but given the extreme difficulty that the employer would have in staying within the tax laws if they allowed coverage to a former domestic partner who is no longer living with their employee, I think it's safe in this case to give you a definite, No, he cannot.

Should I be offered COBRA?

That depends on the employer's plan. Domestic partners have no statutory rights to COBRA. Many employers will offer it anyway. They are not required to by law.

Thank you for the information. I don't want to continue to stay on his plan though he feels it is safe and have claims denied or some legal issues to deal with.
