My question involves an auto loan or repossession in the State of: GA
I went to a buy here pay here auto sales place, I live in a small town in GA(Quitman) and had recently wrecked my car, I am on disability and need to go to Valdosta (15 miles away) several times a week for treatment so I needed a car seriously. I went on Craig's list and there were several cars listed from this place for $3950, so I walked to the sales office, test drove 4 cars and decided on a toyota, I told the salesman several times that I am on disability and I get a check ONCE a month, he told me "no problem just make sure that you pay them as soon as you can" I told him I would be there on the 2nd to make what he called pick-up payments and the monthly payment. He said that I needed to make 4 pick-up payments for $125 to make up the difference for $1500 downpayment, he told me that they had lowered the down payments required but that I would have to pay $1500 down it didn't make much sense to me but I had $1000 so I thought that when the 2nd came I would make the 2 payments of $125 and half of the monthly amount due and then I would borrow the $150 from my dad and it would be fine. I noticed that the left front tire was really bad he told me to come back on Monday( this was saturday) and he would send me to the used tire place and would put a tire on for me, I showed up on monday the day that I was supposed to make the 1st pick-up payments he spoke to me told me where to take the car, at no time did he say that if I didn't pay the pickup payment that they would pick up the car, while I had the paperwork out at my house I noticed that the sales price was listed as $4950, I called the office and got the answering machine, so I just decided that when I came in on the 2nd I would bring it to his attention and get him to fix the obvious mistake no sweat, On monday Feb 27 I woke up and got ready to go to my treatment clinic and went outside and the car was gone, I called the office and the answering machine picked up, I was going to be late so I got my cousin to take me to valdosta on the way there we passed the sales office and there was my car! i called again from the car and no answer, I got my cousin to drop me off there after my dr's visit and the office was locked I walked to my car which was in a line of 6 cars and then a young man came from behind the office he told me that he had repo'd my car, that I could not pay the past due payments the only recourse I had was to pay the entire amount due! I asked to speak to the salesperson I had dealt with and he was "out of town" for a week, I walked across the street where a policeman was parked told him my problem and he came over there asked to see the paperwork and speak to the salesman the man called the salesman told the cop He could speak to him but I was not allowed! he spoke to the salesman, was told the same thing I was and he told the guy he was a crook and he should be shot, he was sorry but it was a civil matter and I should go to the courthouse. the repo guy would not let me get my property from the car unless I signed a release paper for the car, I refused so he said I could not have my stuff. He also said "no to be mad at him he was just doing his job" I told him that is what the Nazi's said too. I do not know what to do. I guess that I just rented a car for 8 days for $1000. what can I do? in the big stack of papers that I signed and initialed in about 5 mins tops apparently I signed a paper saying I wouldn't sue I would agree to arbitration. I filed a complaint with the Federal Trade commission and am going to the court house tomorrow to file against them I don't care about the arbitritian crap. but I want my money back they can shove the car.
