Can You Enter on a H1 Visa Without Being Employed

Dear T53147, thank you for your suggestion, this helped me a leap forward..

My previous employer agreed to offer me my earlier position at senior level as I approached them. Also, couple of job-placement agencies are willing to offer me job based on my professional expertise.

Any work-around is seemingly not possible at this moment, please help.

Find a job that meets the legal requirements for H-1B. Unlike what you have heard, there is no shortage of senior qualified individuals in the US at this time. A legitimate employer would engage the service of an attorney. These job boards - or forums - are not the most reliable sources for information specific to your situation. A legitimate employer would engage an attorney to advise on the preparation of a package of documents for stamping. If you do not qualify, there is nothing more you can do. Asking for a "work-around" seems to be suggesting that you are willing to falsify information in order to enter the US. I am sure if you are well qualified, there is work for you in your home country or as a guest worker in a country with different requirements.

Actually, with what my child went through to obtain a work visa for a country in the EU sponsored by his multinational employer for a position they had been unable to fill for nearly a year with an EU citizen, I find the US requirements to be really undemanding in comparison.
