    Question Dogleg Intersection Collision

    My question involves a traffic accident in the State of: Texas

    I collided with another vehicle in an intersection but there was no major damage to either car. It looked like mainly paint transfer on the other vehicle from my broken side view mirror. But after the accident myself, the other driver and a witness couldn't decide who, if anyone, would be considered "at fault." The intersection is fairly wide and has dogleg from one side of the intersection to the other...basically the lanes on either side of the intersection do not match up. This is much more apparent from the persepective of the left lane than it is from the center or right lanes. I was in the center lane and proceeded straight into the intersection while the vehicle on my left moved into my lane in the intersection and we collided. Did I fail to maintain my lane? Are the three lanes suppose to coordinate a lane change simultaneously in the middle of the intersection? I wanted to call the police and get a report because it was "murky" but the other driver did not. The other driver and the uninvolved witness who stopped both said that it was basically the city's fault for not marking the intersection and they thought it was "no fault" collision.

    are either of you planning on making a claim on either your or the other drivers insurance?

    If not, why does fault matter?

    If you are, not calling the police was not the best of ideas. Have you notified your insurance of the accident?

    I have not called my insurance company because I don't know who is at fault and repairing my broken mirror is going to be around $300 and my deductible is $250...so it doesn't make any sense to file a claim on my end. The other driver's vehicle appeared to only have paint transfer which could be easily removed with a little bit of paint thinner. We didn't feel any dents or gouges in the paint. She said she would have it checked out but didn't think there was any damage but we did exchanged information and each took photos. It if was no fault then there is no point in contacting her insurance company, if I'm at fault then I just pay to replace my mirror, if she's at fault then I could file a claim on her insurance. If the city is suppose have signs posted then I want report the intersection in the hopes that they will post signs. According to the witness and the driver, that intersection has accidents all the time because its very confusing and it was completely redone less than a year ago.

    unless there were lane markings, the duty here was to not run into another person. I think assigning fault would be difficult and without seeing the intersection and the placement of the vehicles, won't hazard a guess to fault.
