    Default My Wife's Attorney Won't Serve Divorce Papers

    My question involves a marriage in the state of: West Virginia

    My wife filed a divorce petition on February 22 but her attorney has not served the papers as of today (March 1). Can anybody give some insight as to what advantage they might be trying to gain?

    There is an emergency DV protection order in effect, issued on February 16 with a final hearing scheduled for April 4.

    Any insights to this situation are much appreciated.

    Why? They have the papers; there must be a reason they won't serve them.

    The attorney would ordinarily turn the papers over to a process server to serve upon you. The process server then adds them to the stack of other papers he's serving, and gets to them usually within a few days. Sometimes the process server tries to serve you when you're not home, and ends up having to come back at a later date. Lots of things could be happening, but a mere week means nothing.
