    Default I Have Sole Custody - Can I Move Out of State

    My question involves a child custody case from the State of: NY

    Hello,

    I have sole custody of my children. The father has supervised visits "at times that both parties can agree upon." He rarely sees the children (his own choice). Do I need his permission to move out of state?

    If it is not addressed in your court order, you will then need to look at your state's requirements. Generally, you will at least need to notify Dad.

    also if you have sole custody by way of a temporary order pending resolution of the outcome of your case i doubt you could stay gone. You can do what ya want but there is consequences.
