    Default Judgments and Garnishment

    My question involves collection proceedings in the State of: Minnesota.
    Okay so let's say a creditor takes you to small claims court and gets a judgment on you, let's say for $1,000.00 or so. Can they automatically garnish your wages with this judgment. By this I mean can they then contact your employer and make arrangement for a deduction from your paycheck to them simply by virtue of the fact they got a judgment on you?
    OR, is garnishee another legal process they have to make another court action for?

    They would have to file a Motion for Writ of Garnishment. The Writ can be issued to garnish wages or bank accounts, depending on what the creditor is able to locate. The Writ that issues is an order of the court, so the Garnishee has no choice but to turn over the amount ordered until the garnishment is released.
