    Default Landlord States He Didn't Sign Lease

    My question involves landlord-tenant law in the State of: Florida

    I signed a lease with purchase option in November. Landlord now states he didn't sign the lease or agree to any of the terms. This was done through his property manager. I have a signed lease so what are my options?

    What is the present issue - what is it that you are trying to enforce, and what is it that the landlord is saying he won't do?

    Who drafted the document? What does the property manager have to say about this?

    The document was drafted by his property manager a licensed real estate agent.

    Trying to enforce the purchase option agreement.

    The property manager who was fired last month says he will testify if i sue to enforce.

    Right now I don't know who to believe. I have seen people sign others names but never ran into it myself so not sure who is telling the truth.

    Just some background. I entered into a 1 year lease with purchase option stating a fixed price. When i entered the lease I was unwilling to commit to buying as this is an area I hadn't lived before. Like the area, like the house. When I informed landlord I was going to exercise my option all hell broke loose. Apparently he is second guessing the agreement and his decision to sell. Sellers remorse shouldn't be a reason for him to back out of a signed agreement.

    If the agent claims he had authority to sell the property, he should have contracts or other documents to back up that claim. If you sue you can present his testimony and the supporting documentation to show that he had the authority to bind the owner to the contract. If the owner denies that the contract is binding and won't abide by it, your options are to live with that outcome, to try to negotiate with the owner to come to a mutually acceptable compromise, or to threaten or file litigation and push ahead until you settle or have your matter resolved by the court.
