Custody After Death

My question involves a child custody case from the State of: Texas. I want to write my testament and thought about who gets the custody in the case I die. I have a child from a previous relationship and sole custody over her. Her father lives in Germany. I am now married and have another child with my husband who has no custody over my first child. I do not want them to be separated in case I die that is why I wanna give the custody over to my parents or my sister - both live in Germany too. Is it possible? Or can my husband adopt my first child after my death?

Legally, Dad - your ex - would be first in line for custody should he choose to be interested.

But I'm a little confused. You don't want your current husband - who is stepdad to your child - to be separated from the child, but you're willing to give custody to relatives in Germany?

I'm not sure what your actual end goal is here - if it's purely to prevent your children from being separated, why not have your husband go through a stepparent adoption now?
