How to Sue a Person Who is Out of the Country

Mr. X, a US Citizen but running his business in China, borrowed a sufficient amount of money from me. By the time due, he refused to returned me the money. How can I sue him in my local (Fairfax, VA) court? Currently, I have the copy of his expired DL. Thanks.

Please keep it in the same thread. We already answered that. Virginia will allow you to service by publication a foreign (which just means someone outside of VA) entity. Of course, if you go to court and get a default judgement, it will be meaningless to enforce against someone in a foreign country Stop screwing around and get a lawyer.

Thanks for you reply. Having very limited knowledge in legal issu, I could not understand it well. I will see my attorney in days. I just want to be better prepared. By the way, the person I want to sue is a US citizen but live in China. He is not a foreigner.

It doesn't matter and we've been all over this 100 times in the other thread. You can't reach this guy if he's outside Virginia in a Virginia court. It's unclear you have any CLAIM to begin with. There is nothing for you to gain here by badgering us with the same question over and over again. If you have a prayer of prevailing against either party, you need a lawyer.
