    Default Which State Has Jurisdiction

    My question involves child support in the State of: Florida

    I live in PA and my children and ex-wife live in FL.
    I currently have my wages garnished by the state of Florida for child support.
    My support amount is based on a large income i used to make while i lived in FL.
    I tried to have the amount lowered but was unsuccessful due to the circumstances.
    i have lived in PA FOR 3 years.
    My children are moving to PA TO live with me while my ex-wife will be staying in FL.
    How do i stop the current FL support order which is garnishing my wages?
    Which state rules will apply to figure out the amount of child support my ex-wife will have to start paying and which state do i have to file with?
    Will my current wages be used in this calculation or will my old wages still be used? Her wages?
    The current order has been in place for over 3 years.

    Your divorce was in Florida, your ex- lives in Florida, the most recent custody and support orders are out of Florida, so Florida has jurisdiction.

    If you want to stop the support order against you, modify custody and get a support order entered against your ex, file a motion in the Florida court that has jurisdiction over the case. Support will be assessed based upon current income.
