    Default Second Bench Warrant for DUI

    My question involves criminal law for the state of: illinois cook county
    So basically I got DUI first time in 2006. First offense ever, I failed to appear in court the first time and was arrested when the cops came to look for me. I was arrested and went to court did community service but but failed the drug test. I was issued a court date I went and told the lawyer that I didn't care about my license I just wanted this over with no community service no drug testing take away my license I diidnt care. He told the prosecutor and he said ok but he gets five days in jaiil. I walked out of the courthouse panicked . I messed up I know. So its been five years and I want to take care of this turn myself in to the local police station and get bonded out the same day. My question is will my family be able to bond me out before I get transferred to county. Should I turn myself in at the county jail? Should I get a bondsmen? If I do have a bond around how much would it be? Basically I want to get out the sameday as I have a job. Thank you for your answers

    You may or may NOT be able to bond out. Since you have a history of not showing up when you're supposed to, the warrant likely has a "no bond" clause to ensure that once you're in custody, you'll stay there until your hearing before the judge. You NEED to be working with a local criminal defense attorney who can get a copy of the warrant for the exact bond information, and, who knows how your local correctional/jail systems interact as far as scheduling and the timing between being apprehended and first appearance. For example, in most places, you'd see the judge the next day (equals one night in jail), in others, there's no court over the weekend, so turning yourself in on a Friday means the weekend in jail and seeing the judge on Monday. The ONLY person who can answer your questions is a LOCAL attorney familiar with your local processes.

    Thank you for the speedy reply aardvarc

    I checked there is no bond. I called the clerk office and they told me I should come in and get it quashed. I'm thinking of getting an attorney to do that for me or do you think I will be able to get it quashed by myself ? Also can anyone refer me to good DUI lawyer in South Chicago Thank you

    PM me and I'll tell you your bond. You walked away from the 5 days. That may not be on the table anymore. You will still be responsible for any fines needed in order to get you license. Failure to pay here could and more than likely will affect your ability to get a license in another state. There are no bondsmen in Cook Co. Your bond is held by the court and that is who will continue to hod it. Your file is no longer at the courthouse that housed it. It is not at 26th and California in the bond court file room. The only way to get it opened is to turn yourself in. If you do so before 11:30, the judge may be willing to retrieve your file and see you right there. If not, you may be held for a hearing date. For which you'd have to pay the bond, or sit until the date arrives. There is a good possibility that youll have an opportunity to plead guilty at your first court date and sit the five days. If you do, you'd be sentences to 10 and get day for day credit. Your supervision would also become a permanent guilty plea.

    Will I need to go to court again for the DUI or will that all be taken care of there?

    Your attorney won't be able to get it quashed . They want you. Your attorney's best perk is usually getting you called sooner than the others on call. They might allow for you to plead right there. With a no bail warrant, you'd probably have to sit for a day or two until they call your case after quashing the warrant. I can think of three judges off the top of my head, that won't give you a speedy judgement.
