    Default Previous Employer Will Not Send W-2

    My question involves employment and labor law for the state of: Texas

    Hi,

    My previous employer will not send my W-2. It is well past the deadline of Jan. 31st and I have requested via e-mail that she send it and she has only replied stating she is filing harassment charges (yea, another issue on my shoulders)

    I can't even report her to the IRS until the 15th of February.

    Will the IRS really do anything about this issue? What will I do without my W-2? She will not send me a copy of my hours and check stubs that I have requested either.

    What else can I do about this issue???

    you wait until Feb 15th and then contact the IRS.

    I presume you do not have any records showing your earnings. Would that be correct? Is there any possibility of determining your earnings and withholdings?

    Yeah I figured that is all I could do.

    I found a couple check stubs around my house but not the last stub for 2011. But I suppose that is better than nothing. If I report her to the IRS will they fine her and if so how much?

    No, it is not. You have no legal entitlement to know what action the IRS takes against any other individual, regardless of what they might have done to you. And what action you take should not be based on what "punishment" she is likely to get.

    Mmm, no. The only thing you're entitled to is your W2. Anything else is between your former employer and the IRS.

    I'm not basing my actions on her punishment. I'm basing my actions on that I will not be able to file my taxes correctly since I do not have my W-2. I don't even believe that any type of "punishment" would be good enough for everything that she has done to me and god knows who else.

    I was just curious to know what the IRS will do in order for her to send my W-2? I'm sure they have the same guidelines for all complaints related to mine. I don't see how or why they would fine one business $5000.00 and another business $3000.00, if they were to do it in that manner. I'm sure it isn't top secret.

    There is a "substitute" W-2 form ... you can complete that and send it in with your tax filing....I have done this many times (sometimes I file on 1 JAN if I am getting $$$ back) w/o issue.
