Hi,
I am staying in a private house on a rental lease agreement of 1 year starting March 06 in white plains, NY. For personal reasons I need to move out of the house by August 31st.
I gave a verbal notice to my landlord on August 2nd. My rental agreement does not mention anything about any sort of penalty for breaking the lease or any written notice period.
Now, my landlord does not agree that we gave her one month notice, and also is not ready to return my security deposit.
Do I have a case, to claim my security deposit back when I move out on Aug 31st?? If the landlord doesnt pay me my deposit, can i file a claim in the Small claims court??
Please provide me some guidance
