Odometer Altered on a Used Car

My question involves a consumer law issue in the State of: Georgia

i bought a 1999 chevorlet silverado with 164,xxx miles on the odometer back in october,23rd of 2011. I was going to sell it in december of 2011 but the guy that was suppose to buy it ran a car fax on it and claimed it stated that in september, 14 of 2011 it showed as having 247,000 miles. that mean that the dealer that I bought it from switched the cluster out on the truck making it seem to have lower miles. all the paper work says miles exempt and so does the title. but from what I have read exempt is put on the bill of sale and the title of any vehicle over 10 years old. it also was sold as is with no warrenty, would it be worth pursuing in court or would it be a waste of time, also what could i even get out of it if i was to win the court case?

It would be worth you time if you could prove that the dealer not only knew about the odometer fraud, but that they switched the cluster out for another one with lower miles. But how are you going to prove that?

It's not against the law to "unknowingly" sell a vehicle that the miles were rolled back on, it's against the law to sell a vehicle that you rolled back the miles on.

However, mutual mistake is grounds for rescission. If both parties thought the odometer was correct and acted accordingly, the error can justify undoing the deal.

It's not against the law to "unknowingly" sell a vehicle that the miles were rolled back on, it's against the law to sell a vehicle that you rolled back the miles on.

the car fax the guy ran said that it stated as of september 14th it had 247000 miles. Im sure somewhere there is proof that he had the vehicle then

Run the CarFax yourself and see if you can get anymore information.

You sate as of 09/14/2011, the vehicle had 247,XXX on the odometer, see what the date and mileage statement prior to 09/14/2011 says?

If you come up with a date - say, 04/01/2011 157,XXX, I'm sure no one had put 90,000 miles on that vehicle in 6 months. And with the truck having 164,XXX, when you bought it, the miles and dates would conclude. It would show that the mileage was entered wrong in CarFax report on 09/24/2011.

If on the other-hand, the mileage states 04/01/2011 233,XXX, you clearly have a discrepancy.

You need to get hold of that CarFax report or order another report to come to a conclusion before hiring a lawyer that will do the same thing I'm telling you, but will charge you for his services.
