    Default Favoritism at Work

    My question involves labor and employment law for the state of: Kentucky

    my boss continually showed favoritism toward another manager. He even told me in my iterview that he held a special relationship with her. Although i am not sure if it was sexual in nature it was well known form the Vice President to the sr HR manager and reported numerous times yet nothing was ever done. As a senior operation manager it became so bad that I resigned. Shoud I persue a lawsuit?

    Favoritism isn't illegal or actionable. If management chooses to allow favoritism, they have the ability to run their business that way. Unless you've got some claim that YOU were illegally discriminated against, there's no suit.

    I was told during my interview by the HR generalist that it was a bad situation. The Vice President of operations would constantly ask me if there was any mor e incidents with the individual in question. The senior HR manager was also made aware yet no action was taken. If another manager would appose or question the judgement of the female manage the diurector would come down on them with fury. He cussed me out as well as two other managers for such incidents. It became an almost hostile environment, it seemed he was retaliating against me.

    Favoritism is not in and of itself illegal. So what law do you believe is being violated?

    Based just on what you posted, I don't see a case. Also; since you resigned, you most likely will not receive UI if you apply/applied.

    A hostile work environment means that there is a pervasive atmosphere of prohibited discrimination. That doesn't apply here. Nor is what you experienced any form of illegal retaliation.

    If the executive management wants to allow a director to favor a manager to the detriment of the business, they can - even if good employees are subjected to abuse and resign. Nothing in the law prohibits a company from making bad business decisions.

    I have to agree, favoritism although very immature, and unprofessional is not illegal, you must prove that you are being treated differently because of a legally protected status such as race. If the employer was abusive, you should have filed a police report, but lets face it that's probably silly unless the abuse was really threatening in nature or truly bullying. Perhaps actions such as this should be illegal but it just isn't at this point. Sometimes in life we have to put up with horrible people, horrible bosses and we shouldn't have to. You could attempt a suit on loss of wages but I don't think you'll win.
