Removing legal father's name and adding bio fathers name
I had my baby's last name changed to reflect her bio's father name through the courts. what i would like to do now is remove the legal father's name from the b/c and add the bio father name. i'm in Florida and i'm having a hard time locating any type of documents that will allow me to do this. I know that i will need a court order to do so but what type of docs will i file my request under?

The legal father will have to disestablish paternity in order for the bio dad to have standing to petition for a name change on the BC. Bio dad will have to be responsible for child support etc and any child support orders will have to be dismissed against the legal father. If the legal father has a relationship with the child they may still get a court order to maintain a relationship. Contact your family court or a family law attorney.

Am I able to file those documents or does the legal father have to file the documents. also i'm not sure if florida allows disestablishing paternity. could a Aop take care of this request and would I have to complete the child support info that is on the Aop. the legal father has no contact with the child and the legal father is holding up to his responsibility.

You can make the petition to disestablish paternity and to dismiss the child support. Contact your local court and child support agency have you proved paternity by a DNA test?

What is the name of the document that i need to file to do this. there is no child support and yes a dna test was done to prove this. i was able to have the name change done already.
