    Default Bank Error in My Favor

    My question involves personal finance in the State of: Texas

    so I went to the bank last week to withdraw some money from my account. i walked up to the teller inside and gave him my debit card and told him i wanted to withdraw $2000. he asked for my id, gave me my cash, then had me sign a cash receipt thing. now i thought when u withdraw money like that it reflects instantly on your account but for the last week my account has shown my balance as never having the money withdrawn. i wasnt sure if those kinds of transactions could be pending or something. ive heard that if u spend the money the bank can threaten u with jail time if they ask for it back and u cant produce it. one of my friends told me though that he had a couple extra hundred in his account that the bank forgot to take out once though and he just closed the account and took the money and never heard a word about it. so my question is can u really just close an account like that and walk away? or is there some kind of law that lets me lay claim to their mistake? if not ill just save myself the headache and temptation and report it to the bank

    If you close the account, when the bank figures out htat you have $2,000 of its money it will want that money back. And it will be legally entitled to the return of its money.

    A $2000 error like you describe should, for all intents and purposes be found and get corrected the same day especially when the withdrawal was made in cash as opposed to, say, a cashiers check or an electronic transfer.

    Now, I know you qualified your withdrawal as being made off of your debit card...

    ... and yet still, something tells me that $2000 came out of a different account than yours, and it will only be a matter of time before it is discovered, debited out of the correct account (YOURS)...

    Unfortunately, the only person who will end up with the short end of the stick on this one is the bank teller who "helped you"; his days of working in finance are likely numbered!!!

    This isn't Monopoly. You don't get to keep the erroneous money, pass go, or collect $200.

    If this is a debit/credit card, as is often the case, perhaps the cash advance was given on the credit account. Check your balance.

    I didn't realistically think I could keep it lol. I was more curious if there might be a reason it didn't deduct right away that I didn't know about other than just their mistake. Do they not do daily audits or weekly ones? To catch these kinds of things? Rest assured though when I go to the bank to tell them today I'll be sure to take their mistake worth of free candy from the dish at the front.

    Then why ask on a legal forum? Try asking on a bank tellers forum how they handle there daily business and mishaps.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......
