My question involves a condominium located in the State of NY.
My condo just took over from the sponsors and had their first annual meeting. At that time I was elected to the condo board with 70% of the vote. However, there is one person who says that I should not have even run because I am related to the Sponsor. They are creating a very big fuss.
The By-laws of my Condo do define an "Independent Board Member" as one who has no family relationship with the sponsor in the glossary. But in another section of the by-laws under the heading "Condo Board Eligibility" it writes:
"Qualification. Each Independent Board Member shall be either a Sold Unit Owner (Including a Sponsor Related Party who acquires a Sold Residential Unit for the bona fide use and occupancy of such Sponsor Related Party or the Sponsor Related Party's Family) or any of the following..."
I am a Sold Unit Owner. And the unit is my primary and only residence.
Can I be on the Condo Board?
