    Default Considered Hostile Work Environment for Colorado Law

    My question involves unemployment benefits for the state of: Colorado

    I got laid off from my position in mid October and got approved for unemployment. I then found a new job by end of October so I did not receive benefits and let the claim "expire". I have been at my new position for almost three months now and I am terribly depressed, I have gained 13 pounds in the 3 months working here, we are constantly watched and asked on our progress in sales numerous times per day. We are expected to do "strongly encouraged" overtime that if you do not show up for shows the management you do not care about your job. Not to mention that we are frequently asked when we come in if we are staying late for more overtime which is very "strongly encouraged" as well. The turn over rate at this place is astronomical.

    To top it off I now have a workers comp claim open with the company. I was told I can still get medical attention if I quit but can I get unemployment? Is this considered a hostile work environment? I appreciate any help possible.

    Hostlie work environment is things like being constantly referred to by racial epithets and having hate-related things like nooses hung on your locker in a consistent and pervasive pattern.

    Telling you to f--king work harder and watching and monitoring you to make it happen is called good management in many circles.

Whether you resign or are fired, your employer's liability for your WC claim is unchanged. No, you cannot receive unemployment benefits if you quit. Not being happy with your work environment is not "good cause" to quit and receive UC benefits under any State's UC statutes.

    Is this considered a hostile work environment? Not even close.

    What you need to do is start looking for a new job and when you accept an offer, join the many ranks of individuals who have quit this company.
