    Angry How to Appeal a Domestic Violence Restraining Order

    My question involves restraining orders in the State of: Ohio

    How do I appeal a Domestic Violence Case against me where Judge denied my evidences video, audio, stated no "Foundation", which showing that the Petitioner was the abuser who was beating me on the video. On the audio she was asking me for money and scary with me with a knife for not giving her any money.

    Judge said that he found no evidence that the Petitioner was motivated by money. And, he found me unreliable.

    I have talked to lawyers but asking me lot of money. In a price of $1500.00, what would a retainer feel like? How much I would expect to pay a lawyer hourly to appear Domestic Violence case?

    Some lawyers ask to be paid in full amount in. Some ask to pay half. Some ask to pay hourly and with a retainer fees. Which one best.

    Was this a criminal charge of domestic violence against you, or a civil case such as a domestic violence restraining order? Makes a HUGE difference, as a criminal appeal is much harder, more strict, and more expensive than a RO case.

    Did you have an attorney in the original case, as you should have?

    I am not sure whether it was civil or criminal. Based on how the lawyers I have tried to talk to, they all asked me for same price, but different arrangement of payment. But none of them ever asked the question you asked me.

    No, I couldn't afford to pay a lawyer to represent me. Restrained order kicked me out of the apartment I was share with my wife, and the monthly payment I make not enough to hire a lawyer, otherwise, I would have to sleep on in the street.

    I believe my case was a set up, a plot against me for being a dissident. They worked out their ways to pressure my wife to attack me, and video posted on Youtube with my iPod, denied by the judge as evidence. The woman never been beaten by me. She had no physical damage, scratch on her body by me. Except her words, her free lawyer and the judge using her to make money on her and me, while our kids living now with no father. She's afraid of the judge and her lawyers, not me.

    Judge helped my wife to commit perjury by helped her to find words to say by asking her questions after questions when she said I abused the kids.

    You posted this question in a forum about restraining orders, so the short answer is: If you're served with a temporary restraining order you make a timely request for a hearing on the restraining order and present your case at that hearing as to why the order should not be made permanent. You will almost always benefit from representation. If you lose, you file a timely appeal - if you've been quoted $1,500 for an appeal of any sort, that's cheap.

    If you have questions about the associated criminal charges it would make sense to post them in the proper forum.

    You typed a lot words and more then two sentences, but you didn't say much to hep me with the question l asked. See, l didn't waste time at ( forum.expect.com ) because it's a bunch of spammers and racists folks there. I thought l 'd come here for honest, effective answers to my need.

    l have been violated of my Human Rights because of my resented comments and blog posts written online. But they utilized illegal act by using my wife to attacking me like predicted it since they there's no legal actions to prosecute. Me and my wife we predicted that. Many times my wife would come to me saying that " It's because of you they do that"; " Because of you they denied me benefits".

    The question l asked here " How to appeal a DV case in the state of Ohio? What best option to pay a lawyer: 1. A full price of $1500,00; 2. Pay half of it of $750.00; or 3. Pay hourly with a retainer monthly fees of, how much, at least $100.00 monthly?
    That's what l need to know.

    That's entirely your choice.

    What I would do might not fit your budget. And vice versa. It's not a legal question.

    Can you or anyone tell me how " RETAINER FEE" payment work? Let's say out of a price of $1500,00.

    I did...It stated that a monthly fee from $10 up to $70, but it also mentioned that it could be higher. That's what I why I ask here. It described it like a pre-paid legal, and I was referred to a lawyer by pre-paid legal program I have where the receptionist mentioned the word "retainer" to me. But she said that the lawyer would be the one that deciding how much the fees will be.

    I am just worry that it may cost me more then just $100. Or I may be a victim of fraud lawyer like the Judge of Columbus, Ohio violated me and my family Human Rights by imposed fear on my wife to say things things against me. There's a clear conspiracy against Dissident in the U.S. , which most people not comfortable to talk about.
