It's NEVER legal in Illinois. There are about four grades of sex offenses all felonies except for the consensual case when the offender is under 17 and the victim is 9-17, or if the victim is 13-17 and the offender is not more than five years older, in which case it is only a class A misdemeanor.

SEX INVOLVING THOSE UNDER 17 is ALWAYS ILLEGAL.
It matters NOT what the circumstances or relative ages are.
The only thing that changes with relative age is whether it is a misdemeanor (up to a a YEAR in jail) or a felony multiple years in prison.
You'll be a registering as a sex offender either way.
