    Default Do Simple Assault Charges Stay On Your Record

    My question involves criminal records for the state of: Pennsylvania

    I'm not sure if I could post the link for the PA courts of my criminal background? I am going to post the link.

    Does it look like that my Simple Assault charges are still on my record even though it's an old case, and the case is closed? Or are those charges dropped, or even dismissed after 11, and 12 years later? I was an adult at that time. I was 18, but the other person was a minor. The charges was in the M2 degree. The DA at that time said no that he wasn't going to lower the charges, so it was an Misdemanor in the 2nd degree. Do I still have a record, fingerprints, and everything else?

    They are not only still on your record, they are posted online for the world to see. As visible from page 2, you plead guilty and from further down, were given 3 months probation.

    Yes. Convictions as an adult don't go away with time. They are on your record forever until and unless they are expunged - and even then, they can still be seen by certain government interests.

    No.

    You plead guilty to a second degree misdemeanor. You will be stuck with this for a long time. Not much you can do about it now. Did you have a lawyer?
    Did he not look into ARD or perhaps pleading it down to a summary offense or was this already a plea bargain down from something more serious?

    There is NO expunction of criminal convictions in Pennsylvania for practical purposes (you have to be at least 70 years old or dead).
    There are pardons, but they are not a routinely issued thing.

    I did have a lawyer, but he was no help. In fact, he was against this. The Probation Officer was the one who spoke to the DA by pleading it down to either a Misdemeanor in the third degree, or even a Summary Offense, and the DA told the PO no it's not happening, so it remains in the second degree. It was always that charge, and nothing more serious.

    Plea bargains and ARD are almost entirely at the discretion of the DA. You're screwed, sorry.

    That was like 12 years ago, and I heard the public got Skumanick to resign that would be George. He had my case at the DA. I won't go into much detail since it wasn't involving me. What would the DA do since it's 12 years later, and I would get a better lawyer?

    There's nothing for the DA to do. You pled guilty. The case is over.

    You do not get to keep going back until you get the charge you want. It is a court of law, not a department store.
