I defaulted on a student TERI loan in the mid 90's. It was sent to a collection agency who contacted me several times. There were very nasty and demanded I pay $500 a month which was way over of my budget. They kept threating to sue.I ageed that that I owed the money and signed an Argeement for Judgement. Then they sent me a copy of the notice they sent to the court in Cambridge, MA on 1/22/02 that stated that they were requesting an Execution be issued in this matter.
However it is now 2006 and I have recieved nothing else.
Since there is no time limit on collection, I fear this will come up soon. I would like to be proactive but I still can't pay $500 a month. How should I proceed to protect myself?
What type of lawyer should I consult? JK
If they initiate garnishment or execution, you can consult a lawyer who handles debtor-side issues in collection matters. Until then, I doubt that a lawyer can do much but tell you to try to pay off the debt, or wait and see what happens.
