    Default Smuggling Drugs

    I have a wife and three small children. My wife's grandfather was found guilty of smuggling drugs and was originally going to do 7 years but his sentence was reduced to 3-5 and he was out in 2(he's in his 70's). He was also deported to Mexico. This took place about 7 or 8 years ago. Shortly after he was deported, he returned illegally and is now wanting to spend time with my family.

    So, how serious of an offense would warrant a 7 year sentence?
    What kind of consequences could I face if he is discovered, and I associated with him knowing the situation?

    It depends on the laws of the state or jurisdiction where he was convicted, as well as the drug involved. You can get that type of sentence with a relatively small amount of cocaine, or a significant quantity of marijuana.

    From what you say, the only present legal entanglement is his illegal presence in the U.S. Are you letting him live with you? Are you and your wife (and children) U.S. citizens?

    We were both born in the U.S. and so are the kids(I'm caucasian and my wife is half hispanic/caucasian). He does not live with us and we've seen him once a few years ago. He was convicted in California(cocaine smuggling).
    Let me put it this way, could it be that I am being overly cautious in not wanting to have him at my home due to his illegal status along with his past felony?

    If his only current legal problem is illegal presence in the U.S., having him visit your home isn't likely to draw you into any legal entanglements. But the question of whether you want him in, given his past, is largely a question of personal opinion - I can understand why you wouldn't.

    OK, I just didn't know if his being here illegally, having been a felon was anymore serious. I agree that my biggest problem is whether I want him in my home or not.
