    Default Other Grandparents Wanting Visitation when when They Got Time

    We live in Arkansas. My wife and I have guardianship of our 7 year old grandson. He has cancer. We got him from his parents because they used drugs. We take him to Arkansas Children's Hospital in Little Rock every week for treatments. He was living with his mother, but she was on drugs pretty bad. She got taken to jail for fleeing an accident with our grandson in the back seat, she was high, no insurance, child endangerment. On several occasions when she took him to Children's the staff would notice she was high and wouldn't let her leave with him. We would drive down and get him. Third time was the straw that broke the camel's back. Now here comes the problem. She has visitation with him on Saturday's. She has showed up high two or three times. We made her leave.Now her mother is getting a lawyer and trying to get grandparent visitation. Her mother uses drugs also. We've had our grandson for 7 mos. and she (the other grandmother) has ask to see him twice and we only live 25 miles from her. Our grandson's mother lives with her mother now. The court papers says it has to be supervised visitation at our house. Does the other grandparent have a leg to stand on if it goes to court?

    If she has visitation and is being denied, that's a pretty big leg to stand on. You will want to document your concerns about drug use and intoxication to the court.

    No, the other grandparents don't have court ordered visitation, just the mother and she comes on her visitation time if she has time.

    If you're a guardian, the child has a relationship with the other grandparents, they're suitable for visitation, and they cannot see the child during mom's visits due to mom's continuing problems, then it's quite possible that a court will grant them visitation independent of the mother.

    There are a lot of unknowns here. If in fact they file a case, I suggest consulting with a lawyer in your state, taking with you the documentation for the guardianship and their petition for access.
