    Default How Can Ineligibility Be Removed

    Dear sir
    my interview held on nov 16 on last of interview they give me a refusal work sheet in which they mention that i am ineligbaile for the visa by 212(g) a 6 E.
    reason was that my sister she has interview on the same date she has a fasle date of birth certificate the oficer already know that this is wrong certificate my sister told them its false he ask me does this certificate wrong i ans no sir its write therefore he give me the refusal worksheet.
    now what can i do to remove the ineligbialty

    You lied about a material fact and have been determined to be inadmissible. There is nothing in your post that indicated that you qualify for a waiver. Rule 1 is NEVER lie to US immigration officials. Look elsewhere for your travels; you are not welcome in the US due to your own lie.

    You appear to be trying to reference INA Sec. 212(a)(6)(E); 8 USC § 1162(a)(6)(E),
    Quote Quoting INA Sec. 212(a)(6)(E). Smuggler
    (i) In general Any alien who at any time knowingly has encouraged, induced, assisted, abetted, or aided any other alien to enter or to try to enter the United States in violation of law is inadmissible.

    (ii) Special rule in the case of family reunification Clause (i) shall not apply in the case of alien who is an eligible immigrant (as defined in section 301(b)(1) of the Immigration Act of 1990), was physically present in the United States on May 5, 1988, and is seeking admission as an immediate relative or under section 1153 (a)(2) of this title (including under section 112 of the Immigration Act of 1990) or benefits under section 301(a) of the Immigration Act of 1990 if the alien, before May 5, 1988, has encouraged, induced, assisted, abetted, or aided only the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.

    (iii) Waiver authorized For provision authorizing waiver of clause (i), see subsection (d)(11) of this section.

    (11) The Attorney General may, in his discretion for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, waive application of clause (i) of subsection (a)(6)(E) of this section in the case of any alien lawfully admitted for permanent residence who temporarily proceeded abroad voluntarily and not under an order of removal, and who is otherwise admissible to the United States as a returning resident under section 1181 (b) of this title and in the case of an alien seeking admission or adjustment of status as an immediate relative or immigrant under section 1153 (a) of this title (other than paragraph (4) thereof), if the alien has encouraged, induced, assisted, abetted, or aided only an individual who at the time of such action was the alien’s spouse, parent, son, or daughter (and no other individual) to enter the United States in violation of law.

    Nothing you posted indicates that you qualify for a waiver. You need to speak to a US immigration attorney but do not be surprised if there is no hope based on your lie that was detected.

    There is more to your problem than can be addressed on a forum. You can either file yourself or enlist the assistance of an attorney. No one on a forum can either state what the outcome of a waiver application would be or can assist you further in filing for it.

    For the record, it is far harder with US immigration to be forgiven for a misrepresentation (lie) than to overcome the underlying issue. It makes no sense that someone would lie about a birth certificate unless they were really trying to hide something serious. Your participation in this is certainly a legitimate concern for US immigration officials.

    Do not obtain assistance from anyone other than a licensed US attorney or you will further complicate you case. Expect that it will cost many thousands of US dollars for his fee.
