    Angry Can I Get Two Tickets for the Same Offense

    My question involves a traffic ticket from the state of: WASHINGTON

    I was clocked in at speeding 15 miles over the speed liming (on the freeway). The officer who clocked me called it in and another officer followed suit. So, once I was finished with the first officer, the second officer stopped me as well (for the same offense at the same time). What can I do? Can they just "double dip" like that?

    The same thing happened to a friend recently only with him, he had been snapped on the intersection camera and an officer pulled him over shortly after. Thus, days later, he received his second infraction in the mail (FOR THE SAME OFFENSE!).

    It just seems wrong to me. Is there anybody out there they can shed some light on this egregious use of power? What are my options? What are my rights?

    If your tickets are for speeding in the same location, then you can present that as a defense. You are stating that the location described on the tickets is identical?

    How did you come to be pulled over for speeding that occurred prior to the first traffic stop?

    "Double jeopardy" in WA (and I'm sure elsewhere) attaches whenever two charges "are based on the same single incident and the elements of each crime are essentially identical." You will need to submit SEPARATE discovery requests for EACH infraction. If they do, indeed, specify the same date, time, and location, you SHOULD be able to get one dropped. Read through this thread. It will tell you how to go about contesting these tickets. When you receive your discovery materials, post them in this thread. Then everyone can see what's going on.

    Thank you guys! Now, as for the photo infraction (regarding my friend), does that make a difference? Does Double Jeopardy still apply?

    If both charges are for the same violation (RCW 46.61.055 (3), for example), for the same location, for the same date and time, then YES, one of these should be dismissed.
