    So the 30 days notice that says required is not required if in fact a true trespasser? I know all cases are on an individual basis and I am going to have to move out eventually if the LL doesn't want to make a deal. I just need some time to find a home to rent. a month should be enough time, because of Christmas and whatnot.

    Apparently, this is what your legal aid lawyer is implicitly telling you, it is not required, and even your own lawyer sees you as a trespasser.

    Having said all of this, as a long time LL, December and January are the toughest times of the year for me to find tenants and rent out apartments because no one want to move out because of the holidays unless they are being evicted. Conversely, it would be the best time to make the best deal since LL's are having such a hard time finding tenants.

    In my case, I check out tenants more thoroughly when they come by this time of year to rent as I find a high proportion of them are being evicted, sad to say.

    I hear ya, I have an attorney that I am talking to and he says that we can probably fight the trespassing claim, I guess it is really all up to the judge on what he wants to do. Or maybe the park will strike a deal with me who knows.

    Honestly, I can't see the point of spending money on a lawyer just so you'll fight to get a 30 day notice. In this case, even if a judge agrees with you completely, all you get is a 30 day notice, and then you'll still have to move.

    You're better off spending the money for toys on your kids.

    Just as an advice from a LL, had you gone out and gotten a copy of your credit report, the name of the person in charge of HR at your company, asked me to call, and gone out of your way to prove to me you'll be a good tenant, I would've considered it. I get weak kneed when people try to kill me with kindness and respect.

    If you instead hired an attorney to force me to give you a 30 day notice, no way would I deal with you, EVER. OK, so you got another 30 days. IMHO, if you did that, you're not the type of tenant I'm looking for or want. I run rentals as a business, and if I let tenants make the rules, it's like having the immates run the assylum. NO WAY.

    That's the way I look at running MY rental business, for whatever it's worth.
