    Default Auto Loan Discharge In Chapter 7

    I filed Chapter 7 in California - did not sign a reaffirmation and my chapter 7 became final in March 2006. I continued to make car payments to Wells Fargo Financial however they have not cashed my last 3 checks and today when I went to automated operator there is no account number under my social security or under the old account number. When I talk to Customer Rep. there is no open account.

    When looking at my credit report it says "account closed/included in Chapter 7/discharged...etc). Do they want me to turn in the car? will they repossess down the line. It is not paid off. I dont' know what any of this means.

    If you did reaffirm, then your lender would normally repossess the car and sell it to cover your debt. Sometimes, for whatever reason, lenders are slow to do that after a bankruptcy. There was at least one post in this forum by somebody whose bank never came for the car, but he did not have clear title to the car because of the bankruptcy and couldn't sell it.

    If you want to arrange to turn in the car, contact the lender and find out what they want you to do.
