My question involves a consumer law issue in the State of: Georgia
I was purchasing a Dodge from a Dodge Dealer in GA. I gave the dealer $4000 downpayment and agreed to trade in our 1997 Nissan Maxima for $500. I was told that the vehicle would be delivered early the following week since I was there on a Friday, Nov 11, 2011. 4 days later, i received a call from the dealer stating that I signed the wrong contract so I needed to come in to sign a new contract. I called the salesperson and told her that I was not comfortable with signing any new contract and that I was not comfortable with continuing with the deal. On Saturday, Nov 19, they told me that the car was now available for pickup. At that point, I notified them again that I was not comfortable with moving forward with the deal. The manager now refuses to refund my $4000 and he is insisting that I bring the trade in to him or he will have me arrested. He has the title to the trade in. Since then, I went to another dealer, they ordered a new title and I was able to purchase a vehicle from them. They now have the Maxima.
Please provide me with some guidance as to how I can retrieve the deposit as well as what my rights are in the state of GA.
