    Default Can I Stay in the U.S. Past Visa Expiration Date While Waitng for a Decision (I-539)

    Having B-2 (visitor) Visa, I E-filed for an extension of stay (I-539) on Nov 5th and visa expires on Dec 2nd. Can I stay, while waiting for a decision from USCIS?

    Generally, as long as your application was properly filed in a timely manner, and I assume you have confirmation that it was, you can remain in the U.S. while your application remains pending (although if the review takes longer than 2-3 months it may be necessary to revisit the question).
