    Question Mom Cosigned on a Car Loan for Son but Refuses to Provide Son with Info Needed to Pay

    My question involves an auto loan or repossession in the State of: Texas

    A friend of mine had his mom assist in the purchase of a new vehicle. As I understand it, Mom is the principal borrower & son is the cosigner. Son has had the vehicle for roughly a month and is ready to begin making payments on the vehicle to the finance company. The finance company requires he have his mothers last four of SSN before he can begin making payments. Son asked Mom for last 4 of SSN. Mom refuses to provide the information. Son is unable to obtain Mom's SSN from any other family members. Finance company will only allow him to pay on the loan without Mom's SSN for a service fee of $20.00 per payment. Son will pay the vehicle payment in two (2) installments per month due to personal finances, so is looking at an additional $40.00 on top of the vehicle payment.

    2 Questions:

    1. Does son have any legal standing to have a judge compel mom to provide the information so he may begin paying the loan without the additional service fees?
    2. Does son have any legal standing to get out of the deal? (It has been roughly one (1) month since the paperwork was signed.)

    I have never heard of such a situation. How would the lender know who was making the payment? If you suggest because his name is on the check, look into a cashiers check or money order. That way there is no name associated with the payment yet they get the payment as required.

    2. Does son have any legal standing to get out of the deal? (It has been roughly one (1) month since the paperwork was signed.)
    no but he could simply not make the payments. That way they will start with chasing mom for the money.
