    Default How to be Certain That Your Spouse Can Pay Alimony

    My question involves a marriage in the state of: Michigan and Alaska

    I left Alaska with my daughter in August when I found out about my husbands numerous affairs. I have only been a resident of Michigan for three months. I am in search of just general advise since I am so foreign to divorces. I have proof of his affairs. I am undergoing chemo therapy among other treatments for a serious flare up of Lupus and Nephritis. I am on disability. I need to file for some sort of spousal support in the mean time. He is very controlling. And Bipolar. He will send any where from $400 to $1100. Depending on his mood. I want to get this done but I am concerned that he will quit his job if he feels I am attacking him. Is there any way to prevent him from being able to quit his job?

    I apologize if this is a bit scattered, I am new to this forum thing also.

    How long were the two of you married? Was he ok with your moving with your daughter?

    There is no way to stop him from quitting his job if he so chooses, however that will not negate his responsibilities to your child.

    We have been married for seven years. He is ok with me leaving with his daughter. He has not shown any interest in having custody of our daughter. He is happy with visiting every once in a while.

    My concern is about his responsibilities to provide health insurance for his daughter and my self also. I really need health insurance right now and that is what he is using to manipulate me right now. As soon as we have a disagreement about how much he is sending for child support he pulls out how unhappy he is at work and how he is going to quit, that my health isn't his responsibility any more (we are still married).

    With a short marriage, you might find it hard to convince a court to award anything other than temporary alimony for a short period of time.

    This is really the best option you have. Can't really help much seeing as you're in a different state as well.

    Since you are disabled, you may get a handsome monthly alimony check for the rest of your life.

    See an attorney and ask the judge for your stbx to pay the attorney bill.

    Michigan is a "no fault" divorce state, so you don't need a reason.



    I have only been a resident of Michigan for three months.
    If you file for divorce now, Alaska law will apply. If you wait until you're considered a resident of MI, then MI law will apply.

    How willing and able are you to travel to Alaska to attend court hearings, or, do you have a handsome sum of money at hand to pay an attorney to attend on your behalf? If neither, you'll need to file in MI - but any support order is going to take time, including the time to petition, the time to serve your ex, the time for him to answer, the time for the court to consider any request he might make regarding proper venue, etc. etc.

    He is very controlling. And Bipolar.

    Which he's not obligated to send without a court order.

    No. He's got freedom to quit. He'll still be liable for support.
