    Default Garnishment for Unpaid Student Loans

    My question involes student loan garnishment of wages.

    i have a hearing in united states district court pending a date.
    i trying to find out how much percentage can be taken out of my wages in the state of michigan.

    all avenues of neiogations with the attorneys rep for us dept of justice has been exauasted.
    if 25 % is take out of my check each wk, it will cripple me to the point i can't make my house payments on time and my
    mortage would be in jepordy of going into foreclouse dut to late payments every month.

    is there a hardship clause that would give me the ability to pay less than 25%.

    someone please answer, i am in desperate need of legal advice.

    perhaps brankrupcy would be inorder?

    Google "Brunner Test" - meeting the criteria (nigh on impossible) is the only way you could discharge federal student loans in bankruptcy.
