    Default SOL For Virginia Car Loan

    Does anyone know that SOL for Virginia for a car loan(signed contract). I had a car loan 9 years ago. They never came and repossed the car. It stopped working and I stopped paying. I am not saying that was the responsible thing to do. Anyway, I recd a call from a collection agency yesterday wanting to set up payment for the debt. I have been receiving statements in the mail. However, I have not done anything (pay a cent or acknowledge ) the bill for well over 6 years. Am I still responsible for this bill or has the SOL ran out. If it has, how do I take care of letting them know that I am not going to pay due to SOL running out?

    Standard answer on expired SOL (statute of limitation) and/or validation and/or dispute letters. There are thousands of posts similar to yours on this forum so I have prepared a standard answer.

    SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.)

    The limitations period appears to be five years from the date of default, but there may be facts which cause a different limitations period to apply.
