Visitation across state lines

My ex pays legal child support. He lives in a different state. He's in the army and stays in housing. He's telling me that he has the legal right to take our daughter out of the state that I live in and take her to the state he lives in. We never went to court for visitation. Can he see our daughter when ever he pleases?

You are stating that when he was ordered to pay support, he requested and was given no custody or visitation rights whatsoever? What state issued the order?

He never requested any visitation. I live in IL. The child support was issued in IL.

You didn't answer my question about custody rights. If you're not sure, check the order. If he has no custody rights and no visitation rights, he has no right to visitation, let alone to take the child across state lines. Still, given his stated intentions, I would suggest consulting a lawyer and having the orders reviewed, with an eye toward possibly obtaining an order explicitly denying him the right to transport the child to another state (or formalizing his parenting time in a manner in which the transport could be effected without causing you undue concern).

Forgive me. I'm not to smart when it comes to these things. I should be. All I know is we went to court for child support only. The state took him to court for child support. The order only says how much and how often he has to pay. I hoped that helped.

BTW... I used to have a oop againist him. Hopefully that does in my favor. I do not trust him at all with our daughter. He's abusive and he drinks a lot.
