    Exclamation New York Emancipation

    I am 15 years old, and i know by all recognization of new york i can not legally become emancipated. I live with my mom dad and brother at the moment, and me and my mom get into vicious fights consisting of us throwing things or her pinning me up against a wall. Threatening that she is going to hit me. or "kick my ass". She is a 46 year old women threatening her 15 year old daughter with abuse. I have been in a mental institution for cutting and suicidal tendancies. Reasons because of her. She is not a mother of any sort more of a bad example in my life. Although i am all past that. I have recently obtained a job. And i am looking to become emancipated when i turn 16. I was wondering if there was any chance i could come upon this.

    In my junior year of high school i am going to be an intern for a lawfirm in the city, along with future pursuing that dream. So i am determined the bare the clutches of my evil mother.

    As you saw in the other thread where you posted, although New York does not have a formal emancipation statute, it appears that New York courts will recognize the status of an emancipated minor who meets the following elements:

    • The minor must be aged 16 or older;
    • The minor must reside independently of his or her parents;
    • The minor must be self supporting (although public assistance or court-ordered child support payments made to the minor would not disqualify the minor from being recognized as emancipated);
    • The minor must not be in need of or receipt of foster care; and
    • The minor must be living beyond the custody and control of his or her parents.

    I completely understand the "criteria". I'm more or less asking is there anything i can do to either get out of my household? or some how lessen the control of my mother?

    There is no chance of a divorce between my parents, because my father love the sex. As he has said. Along with he is afraid of losing my brother to my mother.

    Another question. If i do become emancipated when i hit 16, going throw all the legal processes. Is there any chance i could get my brother away from what i have been throw? Without having him go to child services.

    Well then I would contact this law firm your going to intern at and ask them.
