    Default Can the Babies Father Get Away Without Paying

    My question involves child support in the State of: new york

    So I found out through one of our mutual friends that likes me better. Well she sent me the conversation she had with my daughters father. Well saratoga county social services served him court papers and the dss is filing on my behalf and now I hear he supposedly has something up his sleeve so he won't have to pay child support and my daughter is 15 months and is on Medicaid but I was wondering if there is any way that he could get away without paying bc he's claiming he found something out Abt half week but he won't explain it and the only thing we can think of is he cuts his hours down or he takes her for half a week but I have found out that even if he tries to do it that visitation issues are separate but thank you for tour help Abt if there is a way for him to get out of paying child support or her Medicaid premium

    Sounds like the government is going after him for support to reimburse the taxpayers who fund the Medicaid program. If so, at least part of that money will go to them BEFORE any additional amounts get forwarded to you.

    Sure. Lots of ways. He can quit his job, reduce his hours, or "arrange" to be fired or laid off. He'll still be building up what he owes (an arrearage will accumulate), but as a practical matter, he can't be forced to give up money he doesn't actually HAVE. He can work under the table and be paid in cash, in which case he'll have no paycheck garnishment, and child support enforcement will have to attempt other means of collection, such as intercepting any tax returns (which are typically little, if he's being paid in cash), suspending his driving and other licenses, seizing or garnishing bank accounts, etc. It really comes down to how much he's willing to live "off the grid" in order to avoid support payments.
