    Default Can Non-Citizens Get Court-Appointed Lawyers

    My question involves criminal law for the state of: Utah

    My friend was charged with retail theft valued at $3 which classifies it as a Class B misdemeanor. He/she cant afford a lawyer. Ive read on the Utah courts website about the income guidelines to be given a PD and he/she qualifies.

    My questions are, do you need to be a US citizen for you to be given a PD? He/she is not a citizen but is here legally. What papers does he/she needs to bring to the arraignment to acquire a PD? He/she is not employed but his/her spouse is.

    Nope. You can be a lawful permanent resident, an unlawfully present immigrant, or a little green man from Mars. If you meet the income requirements, you can have a PD.

    Your friend will receive information from the PD's office about qualification after the arraignment. The case will be continued.
