My question involves a child custody case from the State of: California, Ventura County
Hi -
I am in pro per in my child custody case.
My ex-husband filed for an ex parte through his attorney back in May 2011.
The ex-parte was for vacation time of a cruise in Sept. 2011, and for attorney's fees.
His attorney called my house, left notice with my mother, and gave the wrong day for the hearing.
I was not present at the hearing. No one from the ct tried to call to ask why I was not present.
He was granted both the vacation time and the attorney's fees - $1500.
I have come to find out that ex parte hearings are for emergencies only and that vacation time would not be such a matter, nor would attorney's fees. I dont understand why the ct would have heard the matter.
Plus, she didnt itemize her fees, just asked the ct for a flat rate, no declaration outlining her work, vague, etc. Just the one sentence - asking for 1500 for fees and costs.
Is there anything I can do at this point to have the order reversed. The vacation has already happened, but reversed as to the attorneys fees. I dont have the money - living with parents, borrowing money, selling my jewelry. Each hearing his attorney is asking for fees.
What can I do?
