    Default Can I Just Be Kicked Out

    My question involves landlord-tenant law in the State of: California

    Hello,
    I have a situation I need help with. So my room mate emailed me tonight basically saying I have a month to move out. She says the living sitution isn't working for her and she wants me out. We rent a 2bedroom/2bath in an apartment complex run by a management company. (So I'm guessing as I write my rent check separately to them every month). At this point I responded to her email by saying we need to find a way to make it work because I quite frankly can't afford to move at this point. I've barely lived here 2 months so it seems really unfair for her to just kick me out because it's not working FOR HER..

    I want to know if I have to wait for the apartment complex's management office to evict me and if they can even do that as I've not violated any part of the lease. It's not my fault the pets that I paid a deposit for and was upfront about bug her even though she knew about them when I moved in. It seems like since I moved in all she does is complain. Of course in a perfect world it'd be easy for me to just move out but it's really not, financially and general stress-wise. Blah. Housing is such a pain lately.

    First, we need to clarify: you are on the lease with the apartment management, right?

    If you're a subtenant, with a month-to-month tenancy, your landlord (in this context your roommate) would have to give you a month's notice to terminate your tenancy and, if you did not move, would be able to file an eviction action at the end of that notice period. You need to figure out if you are a subtenant or have been added to the tenancy with the apartment complex.
