    Unhappy Roommate Gave Notice to Landlord but Didn't Move Out

    My question involves landlord-tenant law in the State of: Minnesota

    Roommate owes past rent and won't move out. What can I do?

    1. Roommate and I on original lease of 1 year. Landlord wanted new lease signed with rent increase. No new lease ever signed. Been Holding over for 6 months.
    2. Roommate behind on rent and gave proper written notice to move out.
    3. Roommate doesn't move out as stated in notice to landlord.
    4. I have new roommate to move in and wanted to sign new lease.

    You can start by following the forum rule against double-posting your questions.

    What does your landlord want to do? After all, you and your roommate are your landlord's tenants.

    Sorry for double post. I thought I posted original in wrong section.

    My landlord (caretaker) just wants back rent paid. My problem is my roommate owes me enough money that I am going to have to sue him. I can see an eviction notice in the near future due to lack of rent being paid. I am wondering what my rights are stuck in a lease with a roommate that won't leave. I studied the lease and there is no provision for holding over, so I assume it's now in a month to month lease. Caretaker says he can't sign a new lease until past rents are caught up.
