Default Allegations of Fraud in an Online Auction, North Carolina
Hello everyone,

I have been selling some Computer Processors on ebay and a gentleman recently purchased 3 from me, all of which were defective on arrival. Following were the terms of my auction. My question is, does this constitute fraud, or does he have a case against me in small claims court? The amount is for $364 and I really dont feel like wasting my time if he has some legal grounds.

"This CPU was pulled from a functioning desktop PC as a part of a mass system liquidation. We recently received a large shipment of these components and are unable to test each unit individually.

Although the processor came from a working unit, this processor is untested by me and may or may not work. There is no guarantee that this is not a defective processor. There is a possibility that this item may not work at all. In affect, we have started the listing at 1 cent with no reserve. Please bid accordingly.

This item is being sold 'as is' and is not eligible for return."

Just to provide a little more insight, these were purchased from a company liquidation auction. My claims were not false because I did not know if they acutally worked, I was only told so by the auctioneers from whom I purchased the Processors from. Others have purchased the same processors, and they worked.

If your claims were false, then it would constitute fraud.
