    Default Doctor Wont Sign DNR Order

    My question involves medical malpractice in the state of: NJ

    I haven't seen a non military doctor in over 10 years and they are pretty useless in my eyes.
    I don't have real health insurance not because I cant afford it because I don't want it. And thanks
    to One Big Ass Mistake America and his forced health care so his "homies" get yet another free ride in life.
    I'm using the VA health care an attempt to avoid having to buy or be fined for not having it. I don't
    plan on ever using the VA health care system but if it means I don't have to buy insurance it works for me.

    Anyway, so medically there is nothing wrong with me, however should anything ever happen I don't want to be saved.
    I have asked a doctor (wouldn't really call him my doctor) if he would sign the order so I wont be forced into spirit crushing
    and out of control debt should anything happen. He refused saying I don't meet the "guidelines" for a DNR order and he wont
    sign off on the form.

    What are my rights with getting a DNR ? I also don't want some guy preforming CPR because if im revived
    the first action is going to be me slugging him.

    If we didn't have these stupid laws that consent is given if the person isn't conscience then I wouldn't need this stupid order.
    Do they validate them at all? I'm thinking about just getting the bracelet online or if need be with a forged form if i have to.

    You don't quality for a DNR order. Should circumstances arise where you WOULD be qualified, you can pursue the issue at that time. They don't get issued to perfectly healthy people, but rather to people whose circumstances in either a hospital, managed care facility, or hospice setting can reasonably forsee a situation where resuscitation would be normal, or whose medical status includes potentially fatal diagnoses. DNR orders are NOT "do not treat me for any thing at any time" orders. If you want the maximum control over what, if any, level of medical care might be provided to you in a state of unconsciousness or other inability to give consent, then a living will or advance directive is appropriate and can be enacted immediately. It will NOT however, prevent CPR in an emergency situation, where there isn't time or knowledge by providers of such a directive. Until and unless you DO qualify for a DNR, your best defense against anyone saving your life is the combination of a living will/advance directive AND a medical alert style notification bracelet.

    It does appear there must be an underlying illness that qualifies one for an out of hospital DNR order. That would prevent the average healthy Joe from enacting a DNR for general issues. Kind of odd, in my opinion.

    Whether you take some illegal action to obtain one or not is up to you. I surely cannot support your actions although I understand your decision in doing so.

    as to Obama care actually being implemented and a citizen being fined for failing to obtain the requisite insurance:

    I think the courts have not finished with this yet.

    wellllllll....the DNR has to be a signed legal document witnessed by a notary. So, there's more involved than merely forging a Physician's signature.

    I'm a former notary.

    A notary's seal does not make something binding. A notary's seal means that the person who signed the document has been confirmed to be the person he says he is. An unenforceable document that is signed and notarized does not magically become enforceable just because a notary seals it.

    Unless he writes us a check, I say he gets nothing.

    For what it is worth... if he is only a tenth as irritating in real life as he has been here, a DNR won't be a problem.
