    Default Notice of Fence Removal

    My question involves real estate located in the State of: New Jersey


    We are planning to remove a fence because we have no use for it. Our neighbor's child has been damaging it and we are tired of the cost of maintaining it.

    They have two dogs that are let out for hours at a time and so out of courtesy we have verbally told them the fence will be coming down. We also plan on notifying them via a certified letter that the fence will be coming down within the next two weeks. Is there anything else we need to do? They are not nice people at all and I am afraid that:

    1. They may seek to have us pay in some way for a new fence to be put up
    2. That they make take some legal actions, as we have had problems with them before.

    Are you certain that it is your fence to remove? In other words, do you know for certain that it is entirely located on your side of the property line and also that it was not put up by the neighbor or a previous neighbor?
