Guardianship in Tennessee

I live in Tennessee, near Nashville; I was asked by my nephew in Indiana if he could live me my family till he completes high school. He's 16 yrs old. His father has agreed to give up rights to his son in order to make this happen.

What is the nessesary road I need to take to obtain guardianship for him to live in TN with my family.

What's the story with the boy's mother?

You would need a guardianship executed by his parents, in a format satisfactory to the school district where he will be enrolled. You may wish to have it drafted by a lawyer.

His Father has full custody. Mother is a junky and gambler and unable to cope with him. Father has his own drug issues and is unable to provide a stable enviroment for him.

My nephew has ADHD and needs treatment for that, my wife and I want to do what is needed to get him on our insurance. His issues may go awaye once he gets to a stable home but that will have to play out.

So your saying that I need to contact the school for one, to see what they will require from us that is acceptable for enrollment?

What about insurance, and everything else?

Okay, its settled.

I made a call to the Child Advocacy Agency in the city my nephews father lives. They told me I had 2 choices; (1) get a lawyer to draw up temporary papers that the father and myself sign or (2) the father goes to the courthouse and fills out paperwork for change of custody. They will be able to tell him then when the court would be. At that time myself and the father would appear before the judge and sign the papers.

The court appearance makes the best sense because it is the only way that we could get insurance (health) for him.

Hey, I know this is several years later, but I just wanted to let you know, you did not have to get a lawyer to do this... You could of gone to the clerks office and they can draw up papers that you and the parents sign, and it cost like $252.50....
And it gives you every right that the parent has.
Just for further notice!
You dont need a lawyer for everything... there are soo many things you can do your self....
I have tow lawyers and I still do things myself!
