How to Parenting Plan, Including School Rights and Custody Time

My DD's dad & I got divorced in Sept 2004. His lawyer typed up the divorce papers & of course they favor him. We each have 50/50 custody. I get no CS. Father is supposed to have insurance on DD but has lost it at least twice for 6 months. Also I had school rights but in 2008 I moved from 20 mins away with my now Dh to another city which put me in a different school district. PP says if I'd move her dad got school rights. Since then DH & I have built a new house 30 mins from my DD's dad & I drive 30 min 4 times a day to take her to school. I want to take him back to court to get school rights back plus change the custody time. The way it's written in the agreement is not what we do now BUT every time my DD's dad gets upset he threatens to force me to go back to the old times. We go week to week now old schedule was he had her Tues night to Sunday night. Then I had her Sun night to Wednes night. Then he got her Wednes night to Friday night. Then I had her Wednes night to Tues night...and then it started over again. It is terrible I know.
So I want to know if I have a leg to stand on to take him back to court & ask for school rights & possibly full custody. Also my DD's dad does not keep up with paying his 1/2 of her expenses (ex- school lunches, sports, dentist, etc.). Thanks:-)

Short answer is no, not likely. Dad has at least a few years of status quo in his favor. You need a change in the child's circumstance.

If he isn't paying according to the court order, you can take him to court for contempt for that.

This is in Missouri. Father was not ordered to pay CS to begin with. I called an attorney 4 yrs ago to discuss if I could take him back to court to revise things & the attorney said not until a life altering situation happened like I got married, had more children, or the school said it would be in Carly's best interest.
I have since gotten married, have a almost 5 yr old step son & I have a 15 month old old. So my DD has siblings/a family here with us. Her 2 bothers will be in the Jefferson County school district as where Carly is not which is not what I want...

Also a change in her father circumstances is that he has a gf who also has a daughter whom my daughter does not get along with. My DD sometimes argues with my step son but it's+ not like she hates him.
