    Default Emancipation Regarding the Military

    My question involves child support in the State of: Indiana

    My ex-husband wants to terminate child support. Our son is 18 years old (19 in September 2011), graduated high school in June 2011, works a part time job with no benefits and was sworn into the NAVY in July 2011. This all sounds reasonable that the child support would terminate.

    Here is my situation and questions--Although he was sworn into the NAVY in July 2011, he does not leave for NAVY Boot Camp until March 2012 (8 months away). The NAVY runs anywhere from 6-12 months behind in sending recruits to Boot Camp. Until that time, he receives no pay from the NAVY and no benefits (ie. health insurance). His part time job is 20-30 hours a week with no benefits and pays minimum wage. I have always covered him under my health insurance. He lives with me and does not support him self completely. For the last 12 years, his dad has only paid child support...no school fees, no health insurance, no medical bills. His dad lives out of state and has paid for him to fly there 1-2 times a year.

    When they say that a child is emancipated when he joins the military, would this still be the case if he is only sworn in and not receiving benefits? Or does it mean if he is currently serving and receiving pay from the military.
    If he is emancipated, what happens with his health insurance?

    It will be a reference to going on active duty.

    Thank you for your response. Would it be unreasonable to propose that the child support end when he leaves for NAVY Boot Camp? Are there any other
    items in my initial thread that would carry enough weight to support the emancipation?
